The Initial Agreement and Deposit

Once you and the buyer reach an agreement, both parties will sign the Purchase Agreement, and the buyer will submit a deposit into escrow. The escrow agent (title company or attorney) acts as a neutral third party managing all funds until closing.

For an agreement to be legally binding, it may require consideration—typically the buyer’s deposit held in escrow until all contingencies are met.
